What is FMLA?

 

 The Family and Medical Leave Act of 1993 (FMLA) is a United States federal law requiring covered employers to provide employees job-protected unpaid leave for qualified medical and family reasons. These reasons include personal or family illness, military service, family military leave, pregnancy, adoption, or the foster care placement of a child.[1] The FMLA is administered by the Wage and Hour Division of the United States Department of Labor.

 

 

미국에서는 자신이 아프다거나, 가족이 아플경우, 직장이 보장된 상태에서 잠시 떠날수 있는 법정허용기간이 있습니다. 여자분들은 임신이나 자녀 출산의 경우도 여기에 해당됩니다.  부모님이 아프다거나 자녀가 아파서 돌봐주어야 할 경우, 직장이 보장된 상태에서 병가를 낼수 있는 조항입니다. 더 자세한 내용과 어떤경우가 더 해당 되는지는 아래로 연락하시어 좀 더 자세한 사항을 알아보시고 필요하신 혜택을 잘 받으시기를 바랍니다.

 

이 노동법에 의거하여, 몸이 아파서 무단 결근한다거나 너무 많이 결근 하는 경우에,  함부로  terminate 시킬수 없는 이유가 될 수 있으므로, 고용주들은 이러한 경우가 있다면 좀더 자세히 알아보셔야 합니다. 저의 경우도, 일한지 5개월 정도 되는 직원이, 몸이 아파서 일주일에 한두번씩은 계속해서 결근을 하고, 나중에는 도저히 용납하기가 어려울 정도가 되어, terminate시키려고 했는데, 직원은 이미 알고, 내가 아파서 그런데 회사는 자기를 terminate 시킬수 없다고 협박아닌 협박도 받았지만, 결국은 일을 한 기간이 1년이 안되는 경우를 이유로, Medical Leave에 자격조건 미달로 혜택을 받지 못하였고, 그래서 결국은 termiate된 경우가 있었습니다.

 

그리고 SDI는 employee가 반드시 내야하는 세금중의 하나로, 이러한 때를 위하여 정부에 들어놓은 보험입니다.

몸아 아파서 일을 할 수 없을 경우에, 직장에서 work related인 경우에는 worker's comp insurance를 claim하지만, 개인적인 신변상의 문제는 EDD에 불구수당을 청구할 수 있습니다.

 

Eligibility

(최소한 1년이상 -min working hours - 1250 시간은 그 회사에서 일을 해야 합니다.)

In order to be eligible for up to 12 weeks (or 26 weeks for Military Caregiver Leave) of unpaid leave (in a 12-
month period) under the Federal Family and Medical Leave Act (FMLA)*, the following criteria must be met:
• You have worked for the Company for at least 12 months (need not be consecutive months, but employment periods prior to break in service of seven years or more need not be counted).
• You have worked at least 1,250 hours in the 12 months preceding this request for leave.
• At the time leave is requested, you either a) work at a worksite with 50 or more employees, or b) work at a
worksite where 50 or more employees are employed by the covered employer within 75 miles of that
worksite.
