Benefits and Protections

During FMLA leave, the employer must maintain the employee’s health coverage under any “group health plan” on the same terms as if the employee had continued to work. Upon return from FMLA leave, most employees must be restored to their original or equivalent positions with equivalent pay, benefits, and other employment terms.


Use of FMLA leave cannot result in the loss of any employment benefit that accrued prior to the start of an employee’s leave.

 

FMLA로 자리를 비우는 동안, 고용주는 반드시 group health plan의 coverage를 일을 할 경우와 똑같은 조건으로 계속 유지시켜 주어야 하며, FMLA에서 돌아올 때까지 일하는 자리, salary, 그리고 기타 회사의 benefit을 보장해 주어야 합니다.

 

FMLA를 갖을 경우, 회사의 잘못된 판단과 감정적인 개입으로 인하여 불이익을 끼쳤을 경우, 법적 소송건으로 번지는 경우도 있으므로 주의를 해야 합니다.
