  • 401K를 회사에서 Benefit으로 제공한다면, Fidelity Bonds를 들어놓으셨으리라 생각합니다. 그렇다면, 어떤경우에 Fiduciary Liability Insurance가 cover가 되며, 또 어떤 경우에 Bond Insurance가 cover되는지 알아보도록

           아래에서 보시듯이 Bond도 일종의 보험의 한 형태로서,  관리자나 책임을 맡고 있는 사람들의 부정직한

           방법으로 일을 처리해서 회사에 손해를 끼쳤을 경우,  Bond의 insurance가 사용되게 됩니다.

 

          covererage의 한계는 plan의 benefit이나 Plan의 benefiticaries에 한하여 cover가 되고, 회사의 Liability 문제는

          보호하지를 못하기 때문에 별도로 Fiduciary Liability 보험이 필요한 것입니다.

 

          중요한것 한가지.

          모든 Liability의 책임은 회사뿐 아니라, 책임을 맡고 있는 책임자들에게 까지 개인적인 Liability가 생기기 때문에

          회사에서는 D&O의 보험을 들어 놓는것입니다. 이것은 개인적인 Liability를 위한 보험이므로, 대개의 경우, 

          회사 Hiring시 Directors and Officers List에 올려 놓는것을 확인하고 들어 가는 경우가 바로 이 때문입니다.

 

          회사의 중책을 맞는 자리로 들어가는 경우에는, 이 점을  반드시 확인하시고 들어가는 것이 좋겠습니다.

 

  • Fidelity bonds are required by law (ERISA bonding). This is a form of insurance for dishonesty situations. When dishonest administrators or trustees have financially harmed an employee benefit plan, these bonds may be used, but only for the benefit of the plan and the plan's beneficiaries. This bonding insurance will not protect the trustees themselves from liability claims and is completely distinct from fiduciary liability insurance.
