You DO NOT complete a Form I-9 for persons who are:

 

1.   Hired on or before November 6, 1986, who are continuing in their employment and have a reason­able expectation of employment at all times; (This exception to the requirement does not apply to seasonal employees or employees who change em­ployers within a multi-employer association. Other limitations may also apply.)

2.   Employed for casual domestic work in a private home on a sporadic, irregular, or intermittent basis;

3.   Independent contractors;

4.   Providing labor to you who are employed by a con­tractor providing contract services (e.g., employee leasing or temporary agencies); or

5.   Not physically working on US soil.

NOTE: You cannot contract for the labor of an individual if you know that he or she is not authorized to work in the United States.

 

1099를 받는 contractor는 이 form을 fill out 하지 않으셔도 됩니다.

그 이외에도 위와 같은 경우에는 fill out하지 않아도 됩니다.  그리고 위의 Note 꼭 참고하시기 바랍니다.

미국에서 일할 권리가 없는것을 알고도, 1099 contractor나 개인적으로 일을 시켜서는 안됩니다.
